Terms of Business
At Hampshire Direct Cremations, we are dedicated to delivering a high-quality service. While we aim to keep our agreements straightforward, it is essential to clearly outline both our responsibilities and those of our clients. This ensures transparency and fosters a shared understanding throughout the process.
- Definitions
“The Company” refers to Hampshire Direct Cremations a division of Jonathan Terry Independent funeral directors of 101 Peartree Avenue Southampton SO19 7JJ and 10 College Place Southampton SO15 2FD
“The Client” means the individual(s) arranging services with the Company.
“The Service” encompasses the services detailed in the associated documents. - Acceptance of Terms
2.1 All service requests made by the Client are subject to these Terms and Conditions. While these terms generally remain fixed, any variations will be documented in writing. 2.2 Estimates provided are non-binding until formally accepted by the Client and confirmed in writing by the Company. - Prices
Prices for specific services may be subject to VAT at the prevailing rate as of the invoice date. Where applicable, VAT will be included in the total price charged to the Client. - Arrangements and Disbursements
The Company’s responsibility is limited to the direct services it provides. While the Company will coordinate with third parties such as, crematoria, or cemeteries on the Client’s behalf and list these as disbursements on the invoice, the Client acknowledges that such third parties are independently accountable for their services. - Size of the Deceased
Funeral arrangements are initially based on standard size assumptions. Once known, the size of the deceased may require changes in coffin, transport, or equipment, which will be reflected on the final invoice. A risk assessment may prompt the use of additional staff or equipment to ensure safety in handling. - Clothing and Personal Effects
The deceased is transferred in their existing attire unless otherwise instructed. Removed clothing is stored for up to two weeks before being disposed of responsibly. Valuables are recorded and managed per the Client’s wishes. The Company is not liable for any loss or damage to items left in the coffin during visitations, and items should be collected within two weeks post-service. - Final Dispersal of Cremated Remains
The Company will act in accordance with the Client’s specified instructions for cremated remains. If, after 10 years, no instructions have been received, the Company will notify the Client’s last known address. If no response is received within three months, the Company will scatter the remains in a private woodland area without a religious ceremony. - Advance Payment of Charges
The advanced payment of all services are required. Failure to provide payment by the due date may result in the cancellation of those services. New arrangements will only be considered once full payment, including any penalties, is received. - Right to Cancel the Contract
Clients have the right to cancel this agreement within 14 days of signing and acknowledging receipt. This right applies regardless of where the contract is signed. If the client wishes to cancel, a written notice must be sent within the 14-day period to Hampshire Direct Cremations at 101 Peartree Avenue Southampton SO19 7JJ and 10 College Place Southampton SO15 2FD - Third-Party Supplies
While most crematoria strive to carry out cremations on the day the deceased is received, this is not guaranteed. According to the “Code of Practice for Cremation,” cremations should occur within 72 hours of receipt. Clients should be aware that some crematoria adhere to this standard rather than same-day cremations. Additionally, fire regulations may limit the number of attendees in certain venues, such as chapels. The Company accepts no liability if mourners are turned away due to capacity limits. - Final Account
The final invoice may differ from initial estimates, as disbursement costs are subject to change. The Client agrees that any additional services requested will be included in the final invoice. Any calculation errors discovered will be corrected, and the updated total will be charged. - Payment
4.1 The Client agrees to be personally responsible for full payment of the Company’s charges and disbursements. 4.2 Payment of all services is required before the direct cremation takes place. 4.3 Funds from the deceased’s bank account may be used to settle the account without awaiting probate. 4.4 Clients seeking assistance from the Department of Works and Pensions (DWP) must inform the Company. DWP payments often do not cover full funeral costs, and the Client is responsible for any balance. - Solicitor/Bank Payments
If an invoice is forwarded to a solicitor or bank trust company, the Client must inform the Company for record updates. - Delay
The Company is not liable for delays in service due to factors outside of its control. In such cases, a reasonable extension for service completion will be granted, or the agreement may be terminated with payment due for services rendered up to that point. - Disputes and Complaints
Should any issue arise regarding the final account or services, the Client should promptly notify the Company. We are committed to resolving disputes swiftly and sensitively. - Data Protection
Hampshire Direct Cremations a division of Jonathan Terry Independent funeral Directors is registered with the Information Commissioner’s Office (no. ZA502209). We adhere to data protection laws and implement appropriate measures to safeguard personal data. Concerns can be directed to [email protected]. - Severability
Each clause of these terms is intended to be independent. If a provision is deemed invalid or unenforceable by a court, it will be adjusted to the extent necessary for enforceability, without affecting the remaining terms. - SAIF Membership
Hampshire Direct Cremations a division of Jonathan Terry Independent Funeral Directors is a member of The Society of Allied and Independent Funeral Directors (SAIF) and abides by their Code of Practice.
